2) Scope

2.1 These Terms and Conditions apply to all offers, orders, bookings and contracts concluded via OVDV BV—especially for:
a) sale of garden equipment, accessories and garden products (“Products”)
b) rental of garden equipment/machines (“Rental Equipment”)
c) services (e.g. garden work, maintenance, repairs)
d) service subscriptions (“Subscriptions”) (recurring services)

2.2 Any terms and conditions of the customer apply only if OVDV BV has expressly agreed to them in writing.

2.3 Where the customer acts as a consumer (B2C), mandatory consumer protection rules take precedence.


3) Service & delivery area (Belgium only / defined regions)

3.1 Sale, delivery, rental and services are available exclusively in the Belgian regions defined in the webshop (e.g. specific postcodes).
3.2 If the delivery/service address is outside this area, OVDV BV may refuse or cancel the order/booking; any amounts already paid will be refunded.


4) Definitions

Consumer: a natural person acting outside their trade/business/profession.
Professional customer: a person/company acting within their trade/business/profession.
Rental period: period from handover/delivery until accepted return.
Appointment: agreed time for delivery/collection/service.


5) Contract formation / confirmation

5.1 Product presentations and prices are subject to change (not a legally binding offer).
5.2 A contract is concluded when OVDV BV confirms the order/booking in writing (email is sufficient) or performs the service.
5.3 For “price on request”, the contract is concluded only once a written offer has been accepted in writing.


6) Prices, charges, taxes

6.1 All prices are stated in EUR. Whether prices include or exclude VAT is shown in the checkout.
6.2 Additional costs may apply (and will be shown before completion), e.g. delivery/collection fees, consumables, deposit, cleaning fees, late return fees, damage/repair costs.
6.3 Obvious pricing/system errors may be corrected; in such cases, the customer may cancel free of charge.


7) Payment & deposit (security)

7.1 Payment methods are those offered at checkout.

7.2 Cash deposit for rental equipment (payable on collection): For equipment rentals, OVDV BV requires a deposit (security) of EUR [X].
The deposit must be paid in cash on collection. Without the deposit, OVDV BV may refuse handover.

7.3 Purpose of the deposit: security against (i) late return, (ii) missing accessories, (iii) exceptional soiling/cleaning effort, (iv) damage from non-contractual use, (v) loss/theft (where attributable to the customer). The deposit is not a fee and will be retained only to the extent of justified claims.

7.4 Refund of the deposit: After proper return and inspection, the deposit will generally be refunded without delay, at the latest within 7 working days, in cash, or—if a cash refund is not possible—by bank transfer to an account specified by the customer.
If an assessment of damage/costs is required, OVDV BV may reasonably retain the deposit until clarification and will inform the customer of the reason and next steps.

7.5 Deductions: Deductions are made only where reasonable, proportionate and traceable. On request, OVDV BV will provide a breakdown (e.g. photos, quote/invoice, list of late days/missing accessories). Normal wear from proper use does not result in deductions.


8) Delivery, collection, access, transfer of risk

8.1 Delivery/collection times are time windows. Delays do not automatically entitle the customer to damages.
8.2 The customer must ensure safe access and—where necessary—be present or provide a contact person. If the customer is unavailable/no access is possible, additional costs (waiting time/second trip) may apply, provided they were communicated in advance.
8.3 Transfer of risk:

for delivery: upon handover to the customer (or nominated recipient)

for collection: upon handover at the collection point


PART A — RIGHT OF WITHDRAWAL (B2C / DISTANCE SALES)

9) Right of withdrawal (consumers)

9.1 Consumers generally have the right to withdraw from distance contracts within 14 calendar days without giving any reason:

Goods/Products: from receipt of the goods

Services: from the date the contract is concluded

9.2 To exercise the right of withdrawal, a clear statement is sufficient (e.g. by email to service@ovdv.be) or the model form in Annex 1.


10) Effects of withdrawal (goods/products)

10.1 OVDV BV will refund payments received in accordance with legal requirements.
10.2 The consumer must return the goods without undue delay and handle them with care.
10.3 The consumer is liable for any diminished value only if it results from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.


11) Effects of withdrawal (services / start within 14 days)

11.1 If the consumer expressly requests that a service or scheduled performance (e.g. delivery/setup/service) begins within the withdrawal period and then withdraws, OVDV BV may charge a proportional amount for services provided up to withdrawal (where legally permissible).
11.2 If a service has been fully performed and the consumer has expressly agreed to the start and acknowledged that the right of withdrawal may be lost upon full performance, the right of withdrawal may lapse in accordance with legal rules.


PART B — SALE OF GARDEN EQUIPMENT & PRODUCTS (GOODS)

12) Product information

12.1 Descriptions, images and specifications are provided for information. Minor deviations (e.g. colour shades, model updates) may occur.
12.2 Safety and operating instructions must be observed.


13) Delivery (sale)

13.1 Delivery methods, costs and estimated delivery times are shown at checkout.
13.2 Partial deliveries are permitted where reasonable.


14) Retention of title

Until full payment is received, the goods remain the property of OVDV BV, to the extent permitted by law.


15) Statutory warranty / conformity (B2C)

15.1 Consumers benefit from the statutory warranty regarding conformity of goods. In the event of a lack of conformity, the consumer is entitled to the remedies provided by law (e.g. repair/replacement; if not possible/reasonable: price reduction or contract termination, subject to legal conditions).
15.2 For second-hand goods, a shorter warranty period may be agreed where permitted, but not less than 1 year.


16) Process for defects / complaints

16.1 Defects must be reported to service@ovdv.be (order number, description, photos/videos where possible).
16.2 OVDV BV will inform the customer about return/inspection. Unpaid (postage-due) returns will be accepted only with prior consent.
16.3 Where a statutory warranty claim is valid, handling will follow the applicable legal rules.


PART C — RENTAL OF GARDEN EQUIPMENT/MACHINES

17) Rental conditions (general)

17.1 Rental equipment must be used carefully, safely and only as intended, in accordance with instructions/handover briefing.
17.2 Minimum renter age: 18 years (or higher depending on the equipment).
17.3 No transfer/subletting to third parties. Use only at the agreed location.


18) Handover, inspection, return

18.1 The customer must inspect the rental equipment upon handover/delivery. Obvious defects must be reported immediately.
18.2 Return must be on time, complete (including accessories) and in the agreed condition. Normal wear from proper use is excluded.
18.3 OVDV BV may document condition on handover/return (e.g. photos/videos).


19) Late return

19.1 In the event of late return, additional rental days and/or a disclosed late fee may be charged.
19.2 The customer is liable for damage/disadvantages resulting from late return, to the extent permitted by law.


20) Damage, loss, theft

20.1 The customer is liable for damage to rental equipment where attributable to them (e.g. improper use, operating errors, failure to follow safety rules).
20.2 In the event of theft/loss, OVDV BV must be informed immediately; where possible, a police report must be filed.
20.3 Repair/replacement costs and reasonable ancillary costs (e.g. cleaning, missing parts) may be charged and offset against the deposit.


21) Consumables, fuel & maintenance

21.1 Whether consumables (e.g. oil, blades, line) are included is stated on the product page/confirmation.
21.2 The customer bears damage caused by incorrect oil/mixture or incorrect use.


22) Deposit – details (rental)

22.0 Cash deposit: The deposit under clause 7.2 must be paid in cash on collection.

22.1 Inspection on return: OVDV BV will check completeness, function and condition (including accessories) promptly.
22.2 Offsetting: Late days, exceptional cleaning, missing accessories and damage may be offset against the deposit.
22.3 Cleaning: If cleaning beyond the normal level is required (e.g. heavy soiling/blockage due to incorrect use), a pre-communicated cleaning fee or the actual, proportionate effort may be charged.
22.4 Objections: The customer may contest a deposit statement within 14 calendar days of receipt by email. OVDV BV will review and respond within a reasonable time.


PART D — SERVICES (ONE-OFF) & SUBSCRIPTIONS

23) One-off services (garden work, maintenance, repairs)

23.1 For variable services (“on request”), the customer will receive written confirmation/offer before work begins (scope + pricing logic).
23.2 Additional work will—where practicable—be submitted for approval in advance.
23.3 Spare parts/material are generally not included unless expressly agreed in writing.


24) Service subscriptions (Subscriptions)

24.1 Scope, frequency (e.g. X services per year) and any fair-use rules are set out on the relevant product page.
24.2 Billing monthly or annually as per checkout.
24.3 Appointments are subject to availability and agreed with the customer.
24.4 Cancellation: The customer may cancel at any time via the customer account or by email; cancellation generally takes effect at the end of the current billing period unless mandatory legal rules provide otherwise.
24.5 Auto-renewal: Where a subscription renews automatically, the term, renewal, price and cancellation route will be shown transparently at checkout and/or in the confirmation.


25) Missed appointments / lack of access

If the customer is not reachable at the appointment or access is not possible, a call-out/waiting/rescheduling fee may be charged—provided this was communicated in advance.


PART E — LIABILITY, FORCE MAJEURE, PRIVACY, LAW

26) Liability

26.1 OVDV BV is liable in accordance with statutory provisions.
26.2 Liability for indirect loss (e.g. loss of profit) is excluded to the extent permitted by law.
26.3 Mandatory liability rules remain unaffected (e.g. intent, gross negligence, mandatory consumer rights).
26.4 The customer is responsible for safe use of products/rental equipment; damage caused by misuse/improper use is borne by the customer.


27) Force majeure

OVDV BV is not liable for delays or non-performance due to force majeure or events beyond reasonable control (e.g. extreme weather, road closures, illness, supply chain disruptions). If this continues for an unreasonably long time, either party may terminate the affected booking.


28) Complaints / customer service

Complaints should be sent to service@ovdv.be (with order/booking number and description). OVDV BV will aim to respond within a reasonable timeframe.


29) Privacy & cookies

Personal data is processed in accordance with the website’s Privacy Policy and Cookie Policy (GDPR).


30) Applicable law & jurisdiction

30.1 Belgian law applies.
30.2 Mandatory jurisdiction rules for consumers apply. For professional customers, jurisdiction lies—where permitted—at the provider’s registered office.


31) Changes to the Terms and Conditions

The version accepted at the time of ordering/booking applies. For subscriptions, material changes will be communicated in advance where required.
