This Privacy Policy explains how OVDV BV, trading as OVDV Tuinmachines (“OVDV”, “we”, “us” or “our”), collects and processes personal data when you visit our website, purchase a product, rent a garden machine, request a repair or other service, subscribe to communications or otherwise interact with us.

This Privacy Policy applies to consumers, business customers, prospective customers, website visitors and contact persons acting on behalf of a company or organisation.

Depending on how you interact with OVDV, we may process the following categories of personal data:

We generally receive this information directly from you. We may also receive information through Shopify, Klaviyo, payment and delivery providers, social media platforms or business contacts where this is lawful and relevant.

Where information is required to process an order, rental, repair, appointment or other service, failure to provide it may mean that we cannot complete your request or perform the contract.

3. Why We Process Personal Data

We process personal data for the following purposes and legal bases:

  • To process orders, rentals and services: including quotations, payments, deliveries, collections, appointments, repairs, maintenance, installations, service agreements, returns and customer support. The legal basis is the performance of a contract or taking steps at your request before entering into a contract.
  • To comply with legal obligations: including accounting, tax, consumer-protection, product-safety and regulatory obligations. The legal basis is compliance with a legal obligation.
  • To operate and secure our business: including fraud prevention, website security, technical support, record keeping, service improvement and the establishment or defence of legal claims. The legal basis is our legitimate interest in operating a secure and effective business.
  • To communicate with you: including responding to enquiries and providing order, appointment, rental, repair or service updates. The legal basis may be contract performance, pre-contractual steps or our legitimate interests in providing customer service.
  • For marketing and personalisation: including newsletters, maintenance reminders, relevant service information and promotional communications. Where legally required, the legal basis is your consent. In limited situations, we may rely on another legal basis where electronic-marketing rules expressly permit this.
  • For analytics and non-essential tracking: where you have provided the required cookie or tracking consent.

4. Marketing Communications and Klaviyo

OVDV uses Klaviyo to manage email subscriptions, communication preferences, customer segments, newsletters, maintenance reminders and marketing campaigns.

Depending on how the service is configured and your choices, Klaviyo may process information such as your name, email address, telephone number, language, purchase or service interests, consent status, campaign interactions and website activity.

Website activity is only used for non-essential analytics or marketing purposes where the required cookie consent has been obtained.

You may unsubscribe from email marketing at any time by using the unsubscribe link included in the email or by contacting service@ovdv.be.

Withdrawing consent or objecting to marketing does not prevent us from sending necessary non-promotional messages about an order, rental, repair, appointment, safety issue or active service agreement.

Future SMS, WhatsApp and Messenger Marketing

OVDV may introduce marketing communications by SMS, WhatsApp, Messenger or another direct-messaging channel in the future.

Promotional messages through these channels will only be activated after the required consent, consent-recording and unsubscribe mechanisms have been implemented.

Consent for one communication channel does not automatically constitute consent for another channel. For example, email consent does not automatically authorise promotional SMS or WhatsApp messages.

If you contact OVDV through WhatsApp, Messenger or another messaging platform, we may process your account identifier, telephone number, message content and attachments to respond to your request. The relevant platform also processes personal data under its own privacy policy.

You have the right to object at any time and free of charge to the processing of your personal data for direct-marketing purposes, including related profiling.

5. Shopify, Service Providers and Data Sharing

Our online store is hosted by Shopify. Shopify processes personal data to provide services such as website hosting, checkout, order management, customer accounts, security and ecommerce functionality.

We may share personal data, where necessary and lawful, with categories of recipients including:

  • Shopify and connected ecommerce providers;
  • Klaviyo and communication providers;
  • payment processors and financial institutions;
  • delivery and collection providers;
  • IT, hosting, security and technical-support providers;
  • accountants, insurers and professional advisers;
  • manufacturers, suppliers or repair partners where necessary to handle a product, warranty or technical issue;
  • public authorities where disclosure is legally required.

Providers processing data on our behalf may only use it for the agreed services and under appropriate contractual and security obligations.

OVDV does not sell customer contact information or marketing consent data to unrelated third parties for their own direct marketing.

6. Social Media and External Links

Our website may contain links to OVDV profiles on external social media platforms.

Where an icon or button is an ordinary external link, the relevant platform does not receive personal data from OVDV merely because the link is displayed. When you click the link, you leave the OVDV website and the platform may process information such as your IP address, browser information and interaction under its own privacy policy.

If you interact with OVDV through a social media platform, we may process your public profile information, messages, comments and other information you choose to provide in order to respond to you and manage our social media presence.

If OVDV later introduces embedded social media content, advertising pixels, chat widgets or similar tracking technologies, these will only be activated after the required information and consent mechanisms have been implemented.
