Website development, technical setup and content support are provided as a service by BBDynamics. OVDV BV remains responsible for the commercial offer, legal information, products, rentals and services presented on this website.

2. Scope

2.1 These Terms and Conditions apply to all offers, orders, bookings and contracts concluded with OVDV BV, in particular for:

a) the sale of garden machines, accessories and garden-related products Products
b) the rental of garden machines Rental Equipment
c) services, such as garden work, maintenance and repair
d) service subscriptions Subscriptions for recurring services

2.2 Any deviating terms and conditions of the customer shall only apply if OVDV BV has expressly agreed to them in writing.

2.3 If the customer acts as a consumer B2C, mandatory consumer protection rules shall prevail.

3. Service and Delivery Area Belgium / Defined Regions

3.1 Sale, delivery, rental and services are only available in the Belgian regions defined in the webshop, for example specific postal codes or service areas.

3.2 If the delivery or service address is outside this area, OVDV BV may refuse or cancel the order or booking. Any amounts already paid will be refunded.

4. Definitions

Consumer: a natural person acting outside their commercial, business or professional activity.

Professional Customer: a person or company acting within the scope of a commercial, business or professional activity.

Rental Period: the period from handover or delivery until accepted return of the rental equipment.

Appointment: an agreed time for delivery, collection, handover, return, repair, maintenance or service.

5. Conclusion of Contract / Confirmation

5.1 Product presentations, descriptions and prices in the webshop are non-binding and do not constitute a legally binding offer.

5.2 A contract is concluded when OVDV BV confirms the order or booking in writing, including by email, or when OVDV BV starts performing the service.

5.3 For offers marked “price on request”, the contract is only concluded after written acceptance of the offer.

6. Prices, Fees and Taxes

6.1 All prices are stated in EUR. Whether prices include or exclude VAT is shown in the checkout or in the offer confirmation.

6.2 Additional costs may apply and will be shown before conclusion of the contract where applicable, for example delivery fees, collection fees, consumables, deposit, cleaning fees, late return fees, damage costs or repair costs.

6.3 Obvious price errors or system errors may be corrected. In such a case, the customer may cancel the order free of charge.

7. Payment and Deposit Security

7.1 Available payment methods are the payment methods shown in the checkout.

7.2 Deposit for rental equipment cash payment on collection:
For the rental of equipment, OVDV BV may require a deposit security in the amount shown on the product page, booking page or order confirmation.

The deposit must be paid in cash on collection or handover, unless otherwise agreed in writing. Without payment of the deposit, OVDV BV may refuse to hand over the rental equipment.

7.3 Purpose of the deposit:
The deposit serves as security for:

late return
missing accessories
extraordinary dirt or cleaning effort
damage caused by improper or non-contractual use
loss or theft, where attributable to the customer

The deposit is not a fee and will only be retained to the extent of justified claims.

7.4 Refund of the deposit:
After proper return and inspection of the rental equipment, the deposit will generally be refunded without undue delay, and no later than within 7 working days.

The refund will usually be made in cash. If a cash refund is not possible, the refund may be made by bank transfer to an account provided by the customer.

If a damage or cost assessment is required, OVDV BV may reasonably retain the deposit until the assessment is completed and will inform the customer of the reason and next steps.

7.5 Deductions:
Deductions from the deposit will only be made in a transparent and proportionate way. Upon request, OVDV BV will provide a breakdown, for example photos, cost estimate, invoice, overview of late return days or missing accessories.

Normal wear and tear from proper use does not lead to deductions.

8. Delivery, Collection, Access and Transfer of Risk

8.1 Delivery and collection times are time windows. Delays do not automatically entitle the customer to compensation.

8.2 The customer must ensure safe access and, where necessary, the presence of a contact person. If the customer is not present or access is not possible, additional costs may apply, such as waiting time or a second journey, provided these costs were communicated in advance.

8.3 Transfer of risk:

For delivery: upon handover to the customer or a recipient designated by the customer.

For collection: upon handover at the collection location.

PART A — RIGHT OF WITHDRAWAL B2C / DISTANCE CONTRACTS

9. Right of Withdrawal Consumers

9.1 Consumers generally have the right to withdraw from distance contracts within 14 calendar days without giving any reason.

For goods/products, the withdrawal period starts from receipt of the goods.

For services, the withdrawal period starts from conclusion of the contract.

9.2 To exercise the right of withdrawal, the consumer must send a clear statement, for example by email to service@ovdv.be, or use the model withdrawal form in Annex 1.

10. Effects of Withdrawal Goods / Products

10.1 OVDV BV will refund payments received from the consumer in accordance with the applicable legal rules.

10.2 The consumer must return the goods without undue delay and handle them with reasonable care.

10.3 The consumer is only liable for any loss of value of the goods if the loss results from handling that was not necessary to establish the nature, characteristics and functioning of the goods.

10.4 Unless otherwise stated, the consumer bears the direct costs of returning the goods.

11. Effects of Withdrawal Services / Start Within 14 Days

11.1 If the consumer expressly requests that a service or scheduled service, for example delivery, setup, repair, maintenance or garden work, starts during the withdrawal period and then withdraws, OVDV BV may charge a proportionate amount for the service already provided, where permitted by law.

11.2 If the service has been fully performed, the right of withdrawal may be lost under the applicable legal rules, provided that the consumer gave prior explicit consent and acknowledged that the right of withdrawal may be lost once the service has been fully performed.

PART B — SALE OF GARDEN MACHINES AND GARDEN PRODUCTS GOODS

12. Product Information

12.1 Descriptions, images and specifications are provided for information purposes. Minor deviations, such as colour differences, model updates or technical improvements, may occur.

12.2 Safety instructions, operating manuals and maintenance instructions must be observed.

13. Delivery Sale

13.1 Delivery methods, costs and estimated delivery times are shown in the checkout.

13.2 Partial deliveries are permitted where reasonable.

14. Retention of Title

The goods remain the property of OVDV BV until full payment has been received, where legally permitted.

15. Legal Guarantee / Conformity B2C

15.1 Consumers are entitled to the statutory legal guarantee of conformity. In the event of a lack of conformity, the consumer has the legal remedies provided by law, such as repair or replacement, and where legally applicable price reduction or termination of the contract.

15.2 For second-hand goods, a shorter legal guarantee period may be agreed where permitted by law, but not less than one year.

16. Defects / Complaints Procedure

16.1 Defects must be reported to service@ovdv.be, including the order number, a description of the defect and, where possible, photos or videos.

16.2 OVDV BV will inform the customer about the return or inspection procedure. Unpaid return shipments will only be accepted with prior consent.

16.3 If a valid legal guarantee claim exists, the claim will be handled according to the applicable legal rules.

PART C — RENTAL OF GARDEN MACHINES

17. Rental Conditions General

17.1 Rental equipment must be used carefully, safely and only for its intended purpose, in accordance with the instructions or briefing provided.

17.2 The minimum age of the renter is 18 years, or higher depending on the type of equipment.

17.3 The rental equipment may not be transferred, lent, rented out or made available to third parties. The place of use must be as agreed.

18. Handover, Inspection and Return

18.1 The customer must inspect the rental equipment upon handover or delivery. Obvious defects must be reported immediately.

18.2 Return must take place on time, complete including accessories, and in the agreed condition. Normal wear and tear from proper use is excluded.

18.3 OVDV BV may document the condition of the rental equipment at handover and return, for example with photos or videos.

19. Late Return

19.1 In the event of late return, additional rental days and/or a previously communicated late return fee may be charged.

19.2 The customer is liable for damage or disadvantages resulting from late return, where legally permitted.

20. Damage, Loss and Theft

20.1 The customer is liable for damage to the rental equipment where the customer is responsible for the damage, for example due to improper use, operating errors or failure to follow safety rules.

20.2 In the event of theft or loss, OVDV BV must be informed immediately. Where possible, a police report must be filed.

20.3 Repair costs, replacement costs and reasonable additional costs, such as cleaning or missing parts, may be charged and deducted from the deposit.

21. Consumables, Fuel and Maintenance

21.1 Whether consumables, such as oil, blades, wire, fuel or similar materials, are included is stated on the product page or in the confirmation.

21.2 Damage caused by incorrect oil, incorrect fuel mixture, incorrect consumables or improper use shall be borne by the customer.

22. Deposit Details Rental

22.0 Cash deposit:
The deposit according to section 7.2 must be paid in cash on collection or handover, unless otherwise agreed in writing.

22.1 Inspection on return:
OVDV BV will inspect the rental equipment promptly after return for completeness, function and condition, including accessories.

22.2 Set-off:
Late return days, extraordinary cleaning, missing accessories and damage may be deducted from the deposit.

22.3 Cleaning:
If cleaning beyond the usual level is required, for example due to heavy dirt or blockage caused by improper use, a previously communicated cleaning fee or the actual proportionate cleaning effort may be charged.

22.4 Objections:
The customer may object to a deposit settlement by email within 14 calendar days after receipt. OVDV BV will review the objection and respond within a reasonable period.

PART D — ONE-TIME SERVICES AND SERVICE SUBSCRIPTIONS

23. One-Time Services Garden Work, Maintenance, Repair

23.1 For variable services or services marked “on request”, the customer will receive a written confirmation or offer before the start of the service, including scope of work and pricing logic.

23.2 Additional work will, where practicable, be submitted for approval in advance.

23.3 Spare parts and materials are generally not included unless expressly agreed in writing.

24. Service Subscriptions

24.1 Scope of service, frequency, for example number of maintenance visits per year, and any fair-use rules are stated on the relevant product page or offer.

24.2 Billing takes place monthly or annually as shown in the checkout or confirmation.

24.3 Appointments are subject to availability and will be agreed with the customer.

24.4 Cancellation:
The customer may cancel the subscription via the customer account or by email. The cancellation generally takes effect at the end of the current billing period, unless mandatory legal rules provide otherwise.

24.5 Automatic renewal:
If a subscription renews automatically, the term, renewal, price and cancellation method will be transparently shown in the checkout and/or confirmation.

25. Missed Appointments / No Access

If the customer cannot be reached at the appointment time or access is not possible, OVDV BV may charge a travel, waiting time or rescheduling fee, provided this was communicated in advance.

PART E — LIABILITY, FORCE MAJEURE, DATA PROTECTION, LAW

26. Liability

26.1 OVDV BV is liable in accordance with the applicable legal provisions.

26.2 Liability for indirect damage, such as loss of profit, is excluded where legally permitted.

26.3 Mandatory liability remains unaffected, for example liability for intent, gross negligence or mandatory consumer rights.

26.4 The customer is responsible for the safe use of products and rental equipment. Damage caused by misuse or improper use shall be borne by the customer.

27. Force Majeure

OVDV BV is not liable for delay or non-performance caused by force majeure or events outside its reasonable control, such as extreme weather, road closures, illness, supply chain disruptions or other unavoidable events.

If such a situation lasts for an unreasonable period, either party may terminate the affected booking or service.

28. Complaints / Customer Service

Complaints can be sent to service@ovdv.be, including the order or booking number and a description of the issue.

OVDV BV will make reasonable efforts to respond within an appropriate period.

29. Data Protection and Cookies

Personal data are processed in accordance with the Privacy Policy and Cookie Policy of the website and the General Data Protection Regulation GDPR.

30. Applicable Law and Jurisdiction

30.1 Belgian law applies.

30.2 For consumers, mandatory jurisdiction rules apply. For professional customers, the competent courts at the registered office of the provider shall have jurisdiction, where legally permitted.

31. Changes to the Terms and Conditions

The version accepted at the time of the order or booking applies.

For subscriptions, material changes will be communicated in advance where required.
